The ethics charges that were brought against Clark by the DC Bar’s Office of Disciplinary Counsel allege that he was dishonest and attempted to interfere with the administration of justice after the 2020 election. An attorney for Clark at the trial attempted to highlight how Clark was working on the behalf of the then-president after the election. But several former higher-ranking Justice Department officials, including then-acting Attorney General Jeffrey Rosen and then-Deputy Attorney General Richard Donoghue, testified at the trial that Clark’s efforts within the DOJ were out of line. Clark brought lawsuits challenging the validity of the DC Bar’s disciplinary proceedings against him. Others who worked for Trump after the election are also facing attorney discipline consequences, with each at different stages.

WASHINGTON (AP) — Prosecutors pushed back Monday against Hunter Biden's move to subpoena documents from Donald Trump and former Justice Department officials in the firearms case filed against the president's son. They argued that Hunter Biden doesn't have enough evidence to support his claims of potential political interference in the criminal investigation against him and urged a judge to reject the subpoena requests. The investigation into Hunter Biden’s taxes and a gun purchase began in 2018, while Trump, a Republican, was still president. The charges against Hunter Biden allege he broke laws against drug users having guns in 2018. No new tax charges have yet been filed, but the special counsel overseeing the case has indicated they are possible in California, where Hunter Biden lives.

Hunter Biden, son of U.S. President Joe Biden, departs federal court after a plea hearing on two misdemeanor charges of willfully failing to pay income taxes in Wilmington, Delaware, July 26, 2023. The criminal probe of Hunter that led to the pending case in Delaware federal court began in late 2018, during the Trump administration. Weiss soon afterward was appointed special counsel in the case by Attorney General Merrick Garland. The prosecutor has been criticized by Trump and his allies for the initial plea deal and for not charging Hunter with more serious crimes. Hunter's lawyers, in turn, argue that the current gun charges are barred by the diversion agreement.

WASHINGTON (AP) — Hunter Biden asked a judge on Wednesday to approve subpoenas for documents from Donald Trump and former Justice Department officials, claiming the former president applied political pressure to a criminal investigation of him. The push for a subpoena comes as defense attorneys fight the federal firearms case filed against Hunter Biden, who is accused of breaking laws against drug users having guns. Hunter Biden had been expected to plead guilty to misdemeanor tax charges over the summer in an agreement with prosecutors that spared him prosecution on the gun count if he stayed out of trouble for two years. ATLANTA (AP) — A federal judge who rejected efforts by former Trump White House chief of staff Mark Meadows to move his charges in the Georgia election subversion case to federal court is set to hear arguments Monday from former Justice Department official Jeffrey Clark on the same issue. Clark is one of five defendants seeking to move his case to federal court. While the ruling could signal an uphill battle for Clark and the others, Jones made clear he would assess each case individually. The practical effects of moving to federal court would be a jury pool that includes a broader area than just overwhelmingly Democratic Fulton County and a trial that would not be photographed or televised, as cameras are not allowed inside federal courtrooms. The law allowing federal officers to move a case to federal court “is designed to protect legitimate federal authority from state and local interference, not to afford a federal forum to individuals who blatantly sought to misuse the weight of federal authority to interfere with matters of state control,” prosecutors wrote.

The indictment of Trump on four new federal criminal charges, all related to the former president’s effort to overturn his defeat in the 2020 election, lays out some of those lies one by one. Even in listing 21 lies, the 45-page indictment does not come close to capturing the entirety of Trump’s massive catalogue of false claims about the election. The lie that the Justice Department had identified significant concerns that may have affected the outcome of the election. (Page 16)The indictment notes that Trump made this claim on his infamous January 2, 2021 call with Raffensperger, whose staff responded that the claim was inaccurate. The lie that Pennsylvania “want[s] to recertify.” (Page 38) Trump made this false claim in his January 6 speech.

The new report concluded officials did not take the intelligence they did receive seriously enough before Jan. 6. "Those agencies failed to fully and accurately assess the severity of the threat identified by that intelligence," investigators concluded. The report found that FBI received a tip in December 2020 that the far-right Proud Boys planned to be in Washington. Peters' committee staffers focused their findings on the "two primary domestic intelligence agencies," the FBI and the Department of Homeland Security's Office of Intelligence and Analysis. The Department of Homeland Security emphasized that it had already ordered a review of its Office of Intelligence and Analysis.

The litigation from Clark is his latest maneuver to beat back ethics charges stemming from his efforts while at the Justice Department to overturn the results of the 2020 presidential election. Clark pressured Rosen and Donoghue to send Georgia a letter claiming falsely that the Justice Department had uncovered voting irregularities there. When they refused, he sought to get Trump to oust Rosen so he could be installed as Acting Attorney General. Both Rosen and Donoghue are expected to be called as witnesses at Clark's public disciplinary hearing in January. In a statement, one of Clark's attorneys said the ethics case against Clark represents a "flagrant misuse" of the disciplinary function and sets a "dangerous precedent."

Trump would not be the first president to be subpoenaed, nor would he be the first former president subpoenaed by Congress. That's based on a Secret Service email from 9:09 a.m. "The head of the President’s Secret Service protective detail, Robert Engel, was specifically aware of the large crowds outside the magnetometers," Schiff said. A Secret Service report at 7:58 a.m. said, "Some members of the crowd are wearing ballistic helmets, body armor carrying radio equipment and military grade backpacks." On Dec. 26, a Secret Service field office relayed a tip that had been received by the FBI, Schiff said. Trump would not be the first president to be subpoenaed, nor would he be the first former president subpoenaed by Congress.
